These Terms govern your use of kommonly. By creating an account or using the service, you agree to them. Please read them together with our Privacy Policy and Community & Safety Guidelines.
1. Agreement
These Terms of Service (“Terms”) are a contract between you and kommonly. “You” means the adult who registers a family account or uses the service on behalf of their household.
If you do not agree to these Terms, do not use kommonly.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to enter a binding contract.
You represent that you are a parent or legal guardian (or have authority from one) to create child sub-profiles and to share information about your family.
3. Your account
One account represents one family. You are responsible for activity under your account, including anyone you invite as a co-parent or family member with login access.
Keep your credentials confidential. Notify us at privacy@kommonly.com if you suspect unauthorized access.
You must provide accurate information and keep your profile reasonably up to date.
4. Acceptable use
You agree not to:
- Harass, threaten, defame, or discriminate against others.
- Post content that is illegal, sexually exploitative of minors, violent, or otherwise harmful.
- Share another person’s private information without permission, including children’s identifying details (full names, schools, exact addresses, photos intended to identify a child, etc.).
- Impersonate another person or family, or create accounts for automated scraping or spam.
- Attempt to bypass security, access data you are not authorized to see, or disrupt the service.
- Use kommonly for commercial solicitation unrelated to genuine community activity, without our written permission.
5. Content and licenses
You retain ownership of content you submit. You grant kommonly a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content solely to operate and improve the service as you direct (for example, showing your profile to families you connect with or posts to members of a community).
You represent that you have the rights to the content you post and that it does not violate these Terms or any third party’s rights.
6. Connections, communities, and events
Connection requests require acceptance by the other family. Community and event features may have additional rules set by organizers; you must follow those rules and our Community Guidelines.
Meetups and activities arranged through kommonly are between participants. We do not supervise in-person meetings and are not responsible for conduct at offline events.
7. Moderation and enforcement
We may remove content, restrict features, or suspend or terminate accounts that violate these Terms or our Community Guidelines, with or without notice depending on severity.
You can report concerns in the app. Moderators may review reports and keep internal notes not visible to reported users.
8. Termination
You may stop using kommonly at any time and may schedule account deletion in Settings (subject to the grace period described in our Privacy Policy).
We may suspend or terminate your access if you breach these Terms or if we discontinue the service. Provisions that by nature should survive (including disclaimers and limitations of liability) will survive termination.
9. Disclaimers
kommonly is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free service, or that you will find specific families, groups, or outcomes.
We are not responsible for the accuracy of user-generated content or for actions of other users on or off the platform.
10. Limitation of liability
To the fullest extent permitted by law, kommonly and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the service.
Our total liability for any claim relating to the service is limited to the greater of (a) amounts you paid us in the twelve months before the claim, or (b) one hundred U.S. dollars (USD $100), if you have not paid for the service.
11. Indemnity
You agree to indemnify and hold harmless kommonly from claims arising out of your use of the service, your content, or your violation of these Terms or applicable law, except where caused by our gross negligence or willful misconduct.
12. Changes
We may modify these Terms. We will post updates on this page. Material changes may also be communicated by email or in-app notice. Continued use after the effective date constitutes acceptance.
13. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Florida, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country apply.
For disputes, contact us first at privacy@kommonly.com to seek informal resolution. If we cannot resolve a dispute, courts in Orange County, Florida may have exclusive jurisdiction, unless applicable law requires otherwise.
